03Service conditions

The service has two parts:

1. The build: we design and build your online store or your website, with your brand, as we did for VIVARUBY (www.vivaruby.store). For example: the catalog, the wholesale minimum order, shipping, orders that reach your WhatsApp already put together, and visibility on Google and in AI tools.
2. The dashboard plan: with the dashboard (dashboard.bottaristudio.com) you run the store every day, with Bottari IA and Estudio IA. The plan also covers someone looking after the store: updates and fixes.

Exactly what goes into your build is stated in your proposal.

Before we start, we send you a written proposal (by e-mail or as a PDF) with: what we will do, what we will deliver to you, the timeline, what we need from you (photos, texts, logo, access) and the price.

When you accept it in writing (an e-mail or a message is enough), the proposal and these conditions form the contract. We confirm by e-mail that we received your acceptance (art. 1108 of the Civil and Commercial Code). If the proposal says something different from these conditions, the proposal prevails, unless it leaves you worse off as a consumer.

The proposal reminds you, in a clearly visible way, that you have 10 days to withdraw and how to do it (art. 1111 of the Civil and Commercial Code).

• The build costs US$ 1,500, in a single payment.
• When it is paid: TO BE COMPLETED: when the build is paid (on accepting the proposal or on launching the store).
• In pesos, we use the official dollar selling rate (dólar oficial, venta) published by dolarapi.com on the day of payment, as with the plans.
• TO BE COMPLETED: whether prices include VAT.

Anything that is not in the proposal is quoted separately, before we do it. We never charge you for something you did not accept in writing.

To build your store we open these accounts with your business's Google account: Clerk (sign-in), Convex (database), Cloudflare R2 (photos and files), PostHog (visit statistics), Sentry (error log), Resend (automatic e-mails), Vercel (the published site). Your store's domain is also registered in your business's name.

• You are the owner of each account. We get in as administrators.
• Some of these services require a paid plan for a site that sells (for example, Vercel requires its Pro plan for commercial use) or charge if usage grows. Before we start, we tell you which ones, what they cost and who pays for them.
• TO BE COMPLETED: who pays the paid plans of each client's accounts (Vercel, Convex and the rest).

The timeline is in the proposal. It runs from the moment we have what we need from you. If something is delayed on your side, the date moves by the same amount. If something is delayed on our side, we tell you in advance, with a new date.

• Before publishing, we show you the working store so you can review it.
• Adjustments included: TO BE COMPLETED: how many rounds of changes the build includes.
• The store is delivered when we publish it on your domain with your OK in writing.
• If we show it to you and 10 business days go by without a reply, we write to you again. Only if that second notice also goes unanswered, and 5 more business days pass, do we consider it delivered. We still fix any errors that show up afterwards (see warranty).

If something we built does not work as the proposal says, we fix it at no cost for 90 days from delivery. The law requires 30 days (art. 23 of Ley 24.240, the Consumer Protection Law); we give you more.

After those 90 days, while you have an active plan, fixing errors in your store is still included in the plan. What is not an error (a new section, a redesign, a new feature) is quoted separately.

After delivery, your store is run with a dashboard plan. The first month of the plan is free. After that, you continue with the plan you choose, with the prices and rules in the terms. We let you know before the free month ends, and nothing is charged unless you choose a plan.

If you do not choose a plan, your store stays published in your accounts, but without the dashboard and without our maintenance.

• Your content and your data: yours.
• The domain and the accounts: yours, in your business's name.
• Your store's code: we give you permission to use it, change it and host it wherever you want, forever and without paying anything more, also if you stop working with us.
• The dashboard and the pieces we use in every store: they remain Bottari Studio's. You use them while you have a plan.

We show your store as an example of our work (as we do with VIVARUBY) only if you give us permission in writing.

What we learn about your business (prices, suppliers, customers, sales, plans) is confidential. Only the people who work on your store see it, and we never tell another business, not even another of our clients. This duty continues after the service ends. The only exception is if a law or a judge requires us to disclose something: in that case, if we are allowed to, we tell you first. You also keep confidential what you learn about how we work.

You have 10 calendar days from accepting the proposal to withdraw, with no reason needed and at no cost (art. 34 of Ley 24.240 and art. 1110 of the Civil and Commercial Code). If you already paid, we refund everything.

So as not to get in the way of that right, we do not start working until day 11, unless you ask us in writing to start sooner.

• If you are a consumer: even if you asked us to start sooner, if you withdraw within the 10 days we refund everything and do not charge you for the work done (art. 1115 of the Civil and Commercial Code).
• If you buy for your business and asked us to start sooner: if you withdraw within the 10 days, we refund everything except the work already done, which we show you itemized and hand over to you.

• You, after the 10 days: you can stop the build whenever you want. You pay only for the work done up to that point, itemized, and we hand it over to you.
• Us: if we cannot finish the build, we refund the part of the price for the work we did not do and hand over what was done.
• The plan: it is cancelled as the terms say.

• Everything stays in your accounts: the store, the data and the domain.
• We give you the owner role of each account (if you did not have it yet), your store's code and a short guide to how it is built.
• We remove our access within 10 business days.
• We delete whatever we have of your business on our side, as the data agreement says.

The same rules as in the terms apply: nothing limits your rights as a consumer or our liability for wilful misconduct or gross negligence. If you buy for your business, our total liability for the build is capped at what you paid for the build.
